2 II. Questions and Answers: 1. Question 1: Item e of the Letter of Transmittal instructions states; Explicitly indicate acceptance of the Conditions Governing the Procurement stated in Section 2.8 of this Request for Proposals. Please provide section 2.8. Answer 1: A typographical error was made. This should be stated as Section II. Conditions Governing the Procurement 2. Question 2: We are in receipt of Amendment # 2 dated November 8, Was there an amendment prior to this one (amendment # 1) since this amendment is labeled # 2? Answer 2: Amendment 1 was issued on October 17, 2017 and is posted on the District web site and Question 3: Please clarify the number of options requested? Amendment # 2 states five options but, lists four. Answer 3: The five options the District has decide to go with are described in the Scope of Work as follows: 1) Leased Lit Fiber Service, 2) Leased Dark Fiber Service, 3) Leased IRU of Fiber, and 4) Self- Provisional Fiber Construction and 5) Transport Only No ISP Service Included (Services Provided Over Third Party Network. (This last options was inadvertently left off on Amendment #2) As previously stated in Amendment #2, multiple options may be proposed for each scope listed above. 4. Question 4: Please provide pricing pages to account for all of the bandwidth levels and contract terms as indicated in the SOW option descriptions. As an example; 120 Month Leased Lit Fiber Service is requested but, no pricing table for this scenario exists. Answer 4: The EXCEL Spreadsheet will be modified to allow this structure 5. Question 5: Does the District have a Statement of Concurrence form that it would like for us to utilize to show proof the bidder is able to obtain a Performance/Payment Surety Bond, in the event one is needed? Or, is this a form that we should obtain from our surety provider? Answer 5: The District does not have a Statement of Concurrence form. We will need the Contractor to obtain this from its surety provider. 6. Question 6: It is our understanding that school districts in New Mexico

3 are limited to a term of eight (8) years for contracting purposes. Your RFP requests pricing for 10 and 20 year terms. Is LCPS waiving the eight year term limit provision as part of its request for 10 and 20 year terms? Answer 6: This scenario is for purpose of comparison with IRU, dark fiber and/or self provisioned proposals which might be submitted in addition to the lit service, in accordance with the E-rate Modernization Order. 7. Question 7: It appears that a clerical error was made in your evaluation point factors as the points only add up to 95 points, rather than 100. Where will the additional 5 points be allocated? Answer 7: A clerical error was made on the evaluation of points. The allocation will be as follows under Cost, 30 Points for Eligible Services and 5 Points for Ineligible Services. 8. Question 8: Past Experience is listed as a factor receiving 5 points in your evaluation factors and states that Past experience with LCPS will also be included. If a service provider does not have past experience with your District but has extensive experience with providing solutions for other school district entities of comparable size and complexity, would the full 5 points be available to that provider? Or, is past experience with LCPS a necessity? If the latter it would seem to unfairly advantage the incumbent service provider. Answer 8: The 5 points is for Past Experience in which a Vendor shall provide detailed documentation of previously completed example projects of comparable size and complexity. All documentation, including logical and physical design maps shall be included, and should demonstrate the level of installation. Photographs desired. Any past experience with LCPS may also be included and will need to follow the same criteria as any other project. 9. Question 9: Notwithstanding statements to the contrary, the District has previously accepted Contractor s standard agreement for negotiation. Is the District still willing to consider Contractor s standard contract as the basis of negotiation for a final agreement? a. If so, will the District s Q&A responses serve as an Amendment to the RFP s requirements allowing Contractor to provide its contract with Contractor s response? Answer 9: The District is not willing to consider the Contractor s standard contract as the basis of negotiations for a final agreement. 10. Question 10: The RFP seems to allude that the District can ignore a

4 contractor s exceptions and/or alternate language and bind the Contractor to the standard terms and conditions upon award. Will the District consider Contractor s exceptions and be willing to negotiate mutually acceptable terms upon award? Answer 10: The District is willing to negotiate acceptable terms upon award. 11. Question 11: Page 16; General Requirements, # 35, 36 and 37; Bid Security, Public Works Act Page 28; #11 Certificate of Public Works Registration We would point out that that the Lit and Dark and IRU Telecommunications Services requested in this RFP are not Public Works Projects as defined by the State of New Mexico, FCC or USAC. There is no transfer of ownership of any assets to facilitate the requested services to the Las Cruces Public Schools or to the State of New Mexico. Therefor we would request that these requirements (items 35, 36 and 37) and page 28 item #11 as pertains to Public Works Projects be waived. We would point out that these exact requirements were also waived by other NM school districts that issued similar RFPs for similar services during last year (E-Rate Year 20). Those districts being; Albuquerque, Los Lunas and Santa Fe. Answer 11: As per NM Statutes Chapter 13 Public Purchase and Property Article 4 Public Works Contracts Section this project may qualify as a Public Works Project. 12. Question 12: Please describe the manufacturer and model # of each of the LCPS owned switches at the sites listed in the RFP. As an example; Cisco Centennial HS. Describe the quantity and capacity of the available (open) ports on each of the switches listed above? As an example; 2 (two) Gbps ports and 1 (one) 10.0 Gbps port Answer 12: Attached is a list of district sites with provider service receiving devices owned by LCPS. Under the heading Active Receiving Device/Interface you will find the brand, model, and the interface type receiving connectivity from the current provider s edge switch. In most cases, the provider hands off their service connected directly to our router/l3 devices. Although do to some buildings placement of installed network equipment, some locations within the building where the current provider s point of entry may not be the same location where our (LCPS) router/layer 3 devices exists. In such situations, the provider s edge switch hands off their service to one of our (LCPS) layer 2 switches and traffic is carried to our router/layer 3 device. While this is our current operational model in these special cases, we would prefer the service provider to also consider the possibly of bringing their services into the location of existing router/layer 3 device (the MDF). Looking at the other
