3 Subpoenas and Lega Requests The IAOC Lega Committee has concuded that we shoud not respond to Authentication Requests from anonymous requestors (i.e. via their counse). Microsemi Inc - ISOC, IETF, ICANN, et a (received 2014-Sep) On 03-Mar-2016 the US 9th District Court of Appeas affirmed a decisions by District Court incuding dismissing Gassey s action, and motions. 5 Trust Wiingness to hod IPR Reated to IANA As previousy reported, the IETF Trust is wiing to hod inteectua property rights reating to the IANA function, incuding IANA trademarks and the IANA.ORG domain name (and other reated names). Since the ast IETF meeting: The ICANN board voted to accept the pan deveoped by the ICG (incuding input from the IETF and other stakehoders). This pan is now being reviewed by the NTIA (of the US Dept of Commerce). 6 Trust Finances The IETF Trust is in process of fiing for tax-exempt status as a 501(c)(3) organization under US Interna Revenue Service (IRS) reguations. The trust currenty and historicay has no revenue and has thus not pursued tax-exempt status. The officia fiing is pending adoption of a forma Confict of Interest (COI) poicy. (see subsequent side) After 501(c)(3) status is acquired, the IETF Trust wi be opening a Trust-owned bank account, funded adequatey from meeting registration revenues, to cover the needs of maintaining the Trust. NOTE: Meeting Registration Revenues received in excess of meeting expenses are and have been used to fund other operating costs, such as the Secretariat, RFC Editor, IASA, and the IETF Trust. 6

8 Confict of Interest Poicy The IETF Trust is panning to adopt an officia Confict of Interest (COI) poicy. This is necessary for tax-exempt status. 9 Records Retention Poicy The IETF Trust reviews the Records Retention Poicy annuay and updates it as needed. This year the Trust pans to adopt an updated version of the poicy, currenty avaiabe for review at: 9

10 Copyright Statements in Contributions to the IETF IETF IPR is managed consistent with BCP 78 and 79. Contributors grant the IETF a icense to pubish contributions, e.g. as part of an IETF document or meeting proceedings. IETF pubications are copyrighted by the IETF and the resuting IPR is hed by the IETF Trust. Contributors are not permitted to incude additiona copyright assertions in contributions. This incudes documents (drafts and RFCs) as we as presentation sides, etc. 10

11 IETF Trademark Usage The IETF Trust hods the trademarks associated with the name IETF and the IETF ogo. Usage of these trademarks is often permitted when referring to the IETF factuay, but icenses may be required for other cases. 12 Hackathon IPR As previousy reported, the IETF does not consider code deveoped at the Hackathon to inherenty be a contribution to the IETF. It may be intentionay contributed, but is not automaticay assumed be. However presentations at IETF meetings, incuding those given at an IETF Hackathon, are contributions to the IETF. Thus the usua IETF poicies appy to these Contributions, incuding copyright icense and IPR discosure rues. This may incude sides that are incuded in the officia proceedings, video of demonstrations, etc. Contributors are responsibe for ensuring that they have the right to make contributions! 12

15 The IETF Trust The IETF Trust was formed on 2005-Dec-15. It has a ega existence as a Trust in the Commonweath of Virginia. It exists to hod inteectua and other property of the IETF. The purposes of the trust incude the advancement of educationa and pubic interest by acquiring, hoding, maintaining and icensing certain existing and future inteectua property and other property used in connection with the Internet standards process and its administration, for the advancement of the science and technoogy associated with the Internet and reated technoogy. 16 Current Trustees of the IETF Trust There are currenty 9 Trustees, a of whom are members of the IAOC. The Trustees have a fiduciary duty to protect the IETF s property!
