Schls are allwed t perfrm and cmmunicate cpyright material in class under a free exceptin in the Cpyright Act (sectin 28). If yur use meets the cnditins set ut belw, yu can perfrm and cmmunicate cpyright material t yur class fr free and withut the cpyright wner's permissin. What is a perfrmance? A perfrmance under the Cpyright Act includes any mde f visual r aural presentatin t an audience, such as: reading a stry, news article, jurnal, handbk r ther literary wrk; playing: televisin prgrams frm free t air and pay televisin; radi prgrams frm free t air radi and digital radi statins; televisin prgrams frm streaming services (eg Netflix, Stan, Prest) a film in any frmat (eg DVD r a film frm itunes, Ggle Play, etc); purchased material in any frmat (eg a film, audi bk, televisin prgram r series); nline televisin prgrams frm catch up televisin (eg ABC iview, SBS n Demand, 7plus); sund recrdings in any frmat (eg CD, DVD, cassettes, digital music frm itunes, Ggle Play); staging a perfrmance f a play; displaying a diagram r plan n an verhead transparency; displaying cntent frm a live website n an interactive whitebard; r reciting a pem. What is a cmmunicatin? A cmmunicatin under the Cpyright Act invlves making cpyright material available nline r electrnically transmitting cpyright material. 2 'Making material available nline' can include uplading material t a digital space fr student access and use via passwrd prtected access such as: a shared drive/intranet (eg Micrsft 365); r cntent r learning management systems (eg Mdle, Blackbard, Brightspace r Equella); r t a clsed class area n an educatin platfrm (eg Edmd, Vers, Ggle Classrm r itunes U). 'Electrnic transmissin' includes ing, streaming r using an electrnic reticulatin system t share material (eg, libraries might have an electrnic delivery system t transmit material centrally). A cmmunicatin des nt include: playing r streaming live televisin r radi prgrams, bkmarking r sharing links t nline film, vides, radi prgrams and games. These activities are nt cpyright activities and therefre d nt require a licence r permissin. When can I perfrm a wrk r audi-visual item in class? Teachers and students can read r perfrm a literary, dramatic r musical wrk, r play sund recrdings and films in class, where it is: in the curse f educatin and is nt fr prfit; and the peple in the audience r class are giving r receiving instructin, r are directly cnnected with the place where instructin is given. What uses f cpyright material am I allwed t make? Sme f the things yu are allwed t d are: use an electrnic delivery system t play a televisin prgram r film frm a central DVD player in the library t a mnitr in the classrm; use virtual classrm sftware t shw cpyright materials, such as films, t external students; recite a pem t students in a virtual class ver Skype, Ggle Hanguts r ther nline cmmunicatin platfrms; play a film frm a cntent r learning management system (such as Mdle r ClickView) in class; make a film available via a cntent r learning management system fr access by distance educatin students fr the purpse f a particular class; and display r prject material t a class, such as a pem, n an electrnic whitebard, flat panel r data prjectr. What abut making material available nline t students and staff? Making material available nline fr students and staff t access invlves cmmunicating that material. It can als ften invlve making an intermediate cpy t get the material in a frm suitable fr uplading nt the intranet r the cntent management system. Sectin 28 allws the cmmunicatin f cntent when it is made merely t facilitate the classrm perfrmance f that cntent. Any cntent that is cmmunicated shuld be remved at the end f the lessn. Fr example, t play a film t yur class yu are able t first uplad that film t yur schls learning r cntent management system (r t yur schls intranet r educatin platfrm) t facilitate yu being able t play the film t yur class. As sn as the lessn is ver thugh, yu must remve the film frm wherever yu ve upladed it t. There is sme verlap between what Schls are allwed t d under sectin 28, the Statutry Licences and the Flexible Dealings prvisin in sectin 200AB.
